The purpose of Sufragium is to promote the participation of citizens in the day-to-day affairs of public bodies (municipality, province, autonomous community, etc.) and private (associations, official schools, unions, political parties, companies, etc. .) to which they belong. Sufragium is a tool specifically designed to promote participatory democracy, so that the different organizations can know the preferences of their members on any of the aspects that the organization itself or its members consider relevant.

By using the Website, you acknowledge having read and accepted these Conditions and Terms of Use, the legal instrument that regulates, together with the Privacy and Cookies Policy [PU1], all the legal relationships with you and the services provided by Sufragium through the Website. Likewise, you acknowledge having the legal capacity required by the legal system to be able to carry out contracting acts. Especially being over 14 years old.

These Conditions and Terms of Use and the Privacy and Cookies Policy will remain at your disposal on the Website, although Sufragium reserves the right to modify them without notifying you in advance. Sufragium will communicate the new Conditions and Terms of Use or Privacy Policy and Cookies once they have been updated. It will be understood that you accept the new Conditions and Terms of Use by simply accessing the Website, once you have been informed that the modification has taken place. As a user, you will be responsible for periodically checking whether modifications or changes have been made to these Conditions, as well as for full compliance with the obligations established therein.

2. Subjects. Definitions.

• “Sufragium”. He is the owner of the Website and the platform, exercising management and administration powers thereof. We also refer to Sufragium when we use the term "we" or, as in this sentence, when we speak in the first person.
• “Administator”. This concept encompasses those entities or organizations that have created a profile on Sufragium in order to encourage the participation of its members in decision-making on matters of interest in their organization or daily activity. In addition to "Administrator user", we refer to them when in these General Conditions and Terms of Use we speak of "body".
• “Registered user”. It is any user registered in Sufragium who is a member of an organization considered Administrator User. When in these General Conditions and Terms of Use we use the terms "you", we do so to refer to all registered users.

3. Description of the service and operation of the Website.

Sufragium aims to encourage the participation of citizens and members of public and private organizations in decision-making on any matter related to their organization or daily activity. To do this, it offers the possibility for Administrator Users and Registered Users, like you, to raise polls on any matter on which they consider it necessary to know the preferences of the other Registered Users that are part of the organization.

The polls are presented in a very simple way: simply by asking a question and indicating several alternative answers, so that the rest of the Registered Users who are part of the organization can choose one of them. The polls will be open for a period indicated when creating the vote and, at the end of this period, all registered Users will be able to know the result of the poll through a graphic or infographic prepared by Sufragium. In this way, the body will have valuable information about the preferences of its members, which will allow it to make more appropriate decisions.

Surveys raised by registered Users must be previously approved by Sufragium or by the corresponding body, and will not be published directly. However, in the event that you consider that any of the published polls violates the regulations or is discriminatory, defamatory, illegal or in any other way contrary to our General Conditions and Terms of Use, we ask you to notify us by sending a message by email to the following address: [contact@sufragium.com].

Of course, the vote is secret, so you can count on having peace of mind knowing that we will never provide the Administrator User with information about the options you choose in any of the polls. We guarantee the maximum confidentiality about your votes.

4. Registration and access.

In order for you to start raising polls or participate in polls already published, you must register with Sufragium, creating an account that attributes the status of registered user to you. It is necessary that you provide us with your personal information, including your name and surname, your (National identity number, passport or driver's license), your gender, your address, your email address, your telephone number, your level of studies, your profession and the private organizations to which you belong. You will also need to choose a password.

To complete the registration process, it will be necessary to attach the images (front and back) of your National identity number, passport or driver's license. In this way we can confirm the authenticity of the data that our users provide us, which allows us to guarantee that the people who participate in a certain survey are actually members of the corresponding public body. That is, they actually reside in the municipality, province or autonomous community that they have indicated.

Once the registration process is finished, you can start showing your preferences in all the polls that have been raised within the framework of your municipality, province or autonomous community, as long as the corresponding public body has the status of administrator user. You can also raise new polls on any matter that you consider relevant.

In addition, to verify that you really belong to the private organizations that you have selected, we will contact them to carry out the verification. We will have to inform them of your personal data so that they can verify that you are part of them. This transfer of personal data is regulated in accordance with our Privacy and Cookies Policy [PU2]. If you want more information about this, we recommend that you read it carefully.

Once you have verified your membership in each selected private body, you can start voting and raising the polls you want about their organization or activity.

5. Obligations of registered users.

As a registered user, you agree to comply with the following obligations:

• You must provide current, accurate and truthful information, as well as report any changes that may occur in the personal data that make up your user profile.
• You must guard the access codes to the platform with diligence, and not assign or allow their use to third parties.
• You must refrain from raising surveys that may be considered contrary to regulations or public order. In particular, you agree not to raise polls on illegal, defamatory, xenophobic, racist, discriminatory, contrary to good customs or that violate or promote the violation of the rights of third parties. Sufragium reserves the right to remove said content and block the user account in those cases in which it becomes aware that it has uploaded inappropriate content.
• You must refrain from introducing any software on the Website that could cause damage or alterations in the functioning of it.
• You must refrain from using the platform to send spam or other unwanted communications.

6. Responsibility.

Sufragium will not be liable in any way for the following issues, which are listed for example but not exhaustive:

• Uses of the platform that are contrary to these Conditions and Terms of Use, as well as those fraudulent, inappropriate or contrary to the Law.
• Alterations of the service produced by failures in the network, in the server or in any other services. However, when such alterations occur, Sufragium undertakes to resolve the incident as soon as possible. In this way, Sufragium will do everything reasonably possible to keep the Website and the service operational, but will in no way be responsible for incidents registered for this purpose.
• The unauthorized access of third parties to the platform, caused either by a lack in the duty of custody of the access codes by the user or by the violation of the security measures provided by Sufragium.
• The external links that the Website contains lead to sites managed by third parties. Sufragium is not responsible for the content or the status of said sites. The use of external links does not imply that Sufragium recommends or approves the contents of the landing pages.

7. Intellectual and industrial property.

All domain names, trademarks, distinctive signs and logos that appear on the Website are the property of Sufragium or third parties and may not be exploited without the express authorization of the owner.

Likewise, all content, including by way of example the texts, graphic elements, infographics, images and design of the Website are the exclusive property of Sufragium or third parties, so no user is authorized to carry out any act of exploitation about them.

8. Duration and termination.

Sufragium reserves the possibility of suspending or terminating the provision of the Website service at any time, of which it will previously warn users. Likewise, it is possible for an organization to delete your Sufragium Administrator User profile, in which case you will not be able to continue raising polls and voting in polls already raised about it. Yes, you can continue to express your preferences in relation to those other organizations of which you are part of that maintain their profile on Sufragium.

The continuity in the provision of the Sufragium service is subject to the will of the corresponding body to maintain it.

9. Regulations and jurisdiction

These General Conditions of Use are governed in each and every one of its extremes by Spanish law. The language of writing and interpretation of this document is Spanish. This document will not be filed individually for each user but will remain accessible through the Internet on this same website.

The parties agree to submit to the Courts and Tribunals that are competent by the rules of procedural distribution.

Privacy Policy

This Privacy and Cookies Policy regulates, together with the General Conditions and Terms of Use, the entire relationship between Sufragium and users. The General Conditions and Terms of Use act as a complement to what is not established by the Policy.

Privacy Policy

All the personal data that you provide us through the Website is included in a file owned by Sufragium, which has the status of Responsible for the File. This file is duly registered in the Registry of the Spanish Agency for Data Protection. Your personal data is necessary and will be used exclusively to maintain and manage the participatory democracy service provided by Sufragium. They will not be used for purposes other than those indicated.

Sufragium will transfer your personal and contact information only to the entities in which you have chosen to register. We need these private organizations to verify that you are part of them, as it is vital to ensure the credibility of the results of the surveys. Likewise, they may process your personal data to maintain relationships with you. These private entities have undertaken to include your personal data in a file duly registered with the General Data Protection Registry, to implement technical and organizational security measures that ensure comprehensive protection of your data and to observe all the remaining obligations established by the data protection regulations. We will only provide your name, surname and email address. We understand that, if you accept the box expressly established for this purpose, you expressly consent to this communication of data, which will be confirmed by the corresponding entity via email.

We guarantee that the meaning of your votes are secret, so we will not deliver the options you have chosen in each poll to the organizations of which you are part.

Sufragium has established sufficient technical and organizational measures to guarantee the security and confidentiality of your personal data and the meaning of the votes you have made, in accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

Sufragium will send you a bulletin or newsletter in case you have expressly consented to it when registering or if you had requested it later. In it we will inform you of the new polls that have been raised in the organizations to which you belong and the results of the same, once the voting period ends. In the event that you do not wish to continue receiving the newsletter, you can unsubscribe from your user profile. Likewise, you will also receive commercial communications from the entities to which you have joined, if you have expressly consented.

You can exercise your rights of access, rectification, cancellation and opposition by sending a communication accompanied by a copy of an identity document to the following email address: privacy@sufragium.com.

Use of cookies

This Privacy and Cookies Policy regulates, together with the General Conditions and Terms of Use, all the relationships between Sufragium and users. The General Conditions and Terms of Use act as a complement to what is not established by the Policy.

The Website uses its own and third-party cookies necessary to provide the service, as well as to monitor and control user navigation. Cookies are text files that are created in your browser and that serve to record your activity on the Website, allowing you a more fluid and personalized navigation and provide you with functionalities such as logging into your profile.

Community of property owners Terms and Conditions

As the property owner of the aforementioned apartment / premises and, therefore, a member of the Community's Board of Property Owners, I express my wish to register my personal data and to register on the Sufragium Platform.

I declare to know that the votes that I carry out through the Sufragium Platform will be counted for the purposes of validating votes cast in the meetings of the Community of Property Owners, as the owner of the premises / flat.

This declaration will take effect for any voting that, in accordance with the legal system, is carried out in the Community of Property Owners through the corresponding Orders of the Day as the owner of the premises / flat.

This declaration will be indefinite and must be revoked expressly and in writing indicating the date, being void the votes made through the Sufragium Platform from the date of presentation of the express revocation.
